Semut president questions the legality of DAP Penang's upcoming biennial elections and as to whether Lim Guan Eng has any hidden agendas.
GEORGE TOWN: Penang DAP will hold its annual state convention and biennial election on Dec 1, but Sensible & Ethical Malaysian United Team (Semut) questions whether the convention and polls to choose new office bearers for Penang DAP leadership will be valid.
Semut president Huan Cheng Guan noted that Section 15(6) of the DAP constitution states that the party’s central executive committee (CEC) are authorised to set dates for such conventions and polls.
However, he pointed out that the Registrar of Societies (ROS) has yet to recognise the CEC re-election held on Sept 29, after the original Dec 15, 2012 polls was declared null by ROS.
“The current CEC is still not recognised (by ROS) and therefore by definition the CEC is still invalid.
“If so, all state-level conventions would be deemed illegal.” said Huan
“Worse still, some sacked members voted in the CEC re-election. These voters are illegal delegates as DAP has never issued membership reinstatement letters to those concerned.
“They should not have voted in first place.
“Is Penang DAP now legal, illegal or legally competent?” asked Huan in a statement here today.
Huan expressed shock on learning that DAP secretary-general Lim Guan Eng submitted a mere three-page report to ROS on the party CEC re-election.
The 60-day dateline to submit the election report as stipulated by ROS, ends on Nov 29.
Huan revealed that Lim did not attach all the necessary documents, such as the list of legitimate delegates, a list of attendees and voters present at the re-election in his report which was submitted to ROS.
He said he had his suspicions as to whether this was a deliberate act by DAP ‘powerful’ leaders to foil ROS’s investigations into legalising the CEC.
If this was the case, he said it would be inevitable deregistering by ROS.
But if this was not, he said it would clearly be a case of legal incompetency.
He said a secretary-general of any political party requires quick action, commitment and pro-active deliberation and promptness in decision-making.
“Failure to meet these expectations should compel one to step down from the post for he would have let the party down.
“After all the hue and cry over the Dec 2012 disastrous CEC election, shouldn’t Lim diligently submit a flawless report?
“What then is the real reason for the submission of such a flippant report?” asked Huan.
Refering to the upcoming DAP Penang convention, he said that it would be a watershed contest between state party member and Lim dynasty supporters.
“The internal polls will be ‘waterloo’ for some Penang DAP stalwarts. It will be a variety of showdowns as there are many issues which could cause the party to implode.
Huan added that rumblings on the ground indicated the presence of a deep divide between dynastic supporters and local grassroot members, so it seems that all might not be well in Penang DAP.
“Will delegates rise to the occasion to give Penang a new breath of life by voting in worthy candidates and not just Tokong devotees?” asked Huan.
